3. Eligibility
3.1. You must be at least 18 years of age to use this Site, create an account, or place an order. By using this Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

4. Products
4.1. We sell plush toys and related merchandise ("Products"). All Products are intended for decorative, collectible, and personal enjoyment purposes. Our Products are CE certified and safe for ages 3 and above; however, adult supervision is recommended for children under 3 years of age.
4.2. We make every effort to display the colors and features of our Products as accurately as possible. However, the actual colors you see depend on your monitor or device, and we cannot guarantee that your display will accurately reflect the actual color of the Product.
4.3. We reserve the right to limit quantities of any Products offered on the Site, to discontinue any Product at any time, and to refuse service to anyone for any reason.
5. Orders and Payments
5.1. By placing an order through the Site, you are making an offer to purchase the Product(s) in your order. All orders are subject to acceptance and availability.
5.2. We reserve the right to refuse or cancel any order for any reason, including but not limited to: product availability, errors in product or pricing information, suspected fraud, or errors in your order.
5.3. Prices are listed in United States Dollars (USD) and are subject to change without notice. The price charged for a Product will be the price displayed on the Site at the time of your order.
5.4. We accept the following payment methods: Visa, Mastercard, American Express, Discover, Diners Club, PayPal, Apple Pay, Google Pay, Amazon Pay, Shop Pay, and ACH Direct Debit. All payments are processed securely through Shopify Payments and third-party payment processors.
5.5. You agree to provide current, complete, and accurate purchase and account information for all purchases. You agree to promptly update your account information, including your email address and payment information, so that we can complete your transactions and contact you as needed.

6.2. "Lumiero," "Lumiero Life," "Velvet Cow by Lumiero," and all related logos, product names, and slogans (including "Soft things. Real feelings.") are trademarks or trade dress of JP Commerce Group, LLC. You may not use any of these marks without our prior written permission.
6.3. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes. This license does not include any resale or commercial use of the Site or its contents.
7. User Conduct
7.1. You agree not to use the Site for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Site.
7.2. You may not attempt to gain unauthorized access to any portion of the Site, other accounts, computer systems, or networks connected to the Site.
7.3. You may not use any automated means, including robots, spiders, or scrapers, to access the Site for any purpose without our prior written consent.
8. Limitation of Liability
8.1. 11.2. Any disputes arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Orange County, Florida, and you consent to the personal jurisdiction of such courts.
11.3. Before initiating any formal legal proceedings, you agree to first contact us at contact@lumierolife.com to attempt to resolve the dispute informally. We will make reasonable efforts to resolve any dispute within 30 days of receipt of your notice.
12. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
13. Entire Agreement
These Terms, together with the Privacy Policy, Shipping Policy, and Refund & Return Policy, constitute the entire agreement between you and JP Commerce Group, LLC regarding your use of the Site.
